Invasion Declaration
Update:
On November 15, 2022, Governor Abbott invoked the Invasion Clauses of the US and Texas Constitutions. We hope that this is not just another PR stunt, but that he will take actual action to secure our border.
Constitutional Basis Of Why Texas Can Secure Its Own Border
- The federal government is obligated to protect states from an invasion (Article IV Section 4 of the US Constitution) but is failing to do so.
- Article I Section 10 Clause 3 of the US Constitution gives states the rights to defend themselves against an invasion if the federal government fails to do so.
- Article 4 Section 7 of the Texas Constitution gives Texas the right to repel an invasion.
The last three months, more than 4,500 foreign nationals have been entering Texas unlawfully EACH day on average!!
If Governor Abbott declares an invasion, he can order the Texas State Guard to defend our state against this invasion of our sovereignty which means they should have the authority to arrest, detain and even deport those that unlawfully cross our border.

Article IV Section 4 of the US Constitution
“The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.”
Article I Section 10 Clause 3 of the US Constitution
“No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.”
Article 4 Section 7 of the Texas Constitution
“GOVERNOR AS COMMANDER-IN-CHIEF OF MILITARY FORCES. He shall be Commander-in-Chief of the military forces of the State, except when they are called into actual service of the United States. He shall have power to call forth the militia to execute the laws of the State, to suppress insurrections, and to repel invasions.”
